Agricultural Real Estate Tax Appeals

Agricultural property is taxed at a lower rate than is commercial or residential property (12 percent of fair market value). Even so, an unjust increase in the assessed value can result in thousands of dollars of additional property taxes.

Attorney Cathy Steele has practiced in this area of the law for over 35 years. She has a sophisticated understanding of the methods county assessors use to grade and value agricultural land, and thus how to challenge a fair market value that her client believes is too high. Property values for agricultural land are reassessed by the county in odd years. The assessor classifies land as either agricultural, commercial or residential – based upon the use of the land.

  • If property zoned commercial is farmable, it may be possible to appeal the classification, plant it and reap the tax benefits of agricultural status (12 percent versus 32 percent of fair market value).
  • If property zoned residential has an operating farm, it may also qualify for conversion and an agricultural assessment rate (12 percent versus 19 percent).

The Board of Equalization will see through a transparent scheme to avoid taxes. We are adept at proving that the land should legitimately be zoned agricultural.
